Donald Derailed By Us Courts As Travel Ban Stayed
US Courts have stayed the executive order of President Trump
Trump had by executive order debarred nationals from 7 countries to travel to the USA, but the US courts have stayed this draconian order striking a blow for freedom.
Donald Trump came to power on the back of populist statements.He ignited the people's latent hatred for Muslims by signing an executive order debarring all residents from 7 nations from entering the USA.This was a draconian step and the ban enveloped 7 nations namely Iran, Iraq, Syria, Sudan, Yemen, Somalia, and Libya.Trump in repeated statement at a press briefing and on Twitter justified the ban as an attempt to save America from radical Islamic terror.
On instructions from Trump thousands of Muslims travelers from these nations were denied entry into the USA.Hundreds were held up at airports as the department of Home and security acted on the Presidential order.Many compared Trump's actions to Hitler and also the fact that it went against the grains of the US constitution.
But the comparison with Hitler ended there as the USA is a vibrant country and the bastion of democracy.With misery piling up at the airports it was a matter of time before the US courts acted.First, a US judge granted a stay on the implementation of Donald's executive order.This was a surprise to Trump who was taken aback.He went on twitter to deride the judge.This was bad politics and in my view lowered the prestige of the US president.
Donald instructed the DOJ( The department of Justice)to file an appeal against the order. the appeal was filed at midnight in the court.The DOJ requested that the stay order is vacated.The Judge hearing the case refused to grant a stay and the matter is back to square one as Donald's executive order is rendered null and void for the present.
These rulings show a vibrant US system of Justice.But there a big IF and that concerns the future.Surely the appeal will go to the US Supreme court or other courts from Donald.He has a strong case as in 1881 a bill was passed by Congress banning the entry of Chinese to the USA.Called the " Chinese restraining order", the act was repealed only in 1943 after 60 years.Donald is sure to quote this as a precedent and that makes Donald's case strong.
But 2017 is not 1881 and the US courts may have a different interpretation this time.Time alone will tell us what happens.But at the moment the civil rights leaders can celebrate as they have stood up to Trump. But the last is not yet heard in the matter.
